TERMS AND CONDITIONS OF USE

clickclinic – Clinical Platform and ERP with Artificial Intelligence

1. SERVICE OWNER IDENTIFICATION

The Skymedic AI service is operated and owned by SKYMEDIC ARTIFICIAL INTELLIGENCE, S.L., with registered office at Isaac Peral n91, (CP 08226), Terrassa, Spain, with C.I.F. B-13857727, registered in the corresponding Commercial Registry (hereinafter, "Skymedic AI" or "the Platform"). Contact by email at info@skymedic.es

2. PURPOSE OF THE SERVICE

Skymedic AI is a digital platform for clinical support and healthcare management, offering tools for:

  • Digital clinical records
  • Facial analysis using artificial intelligence
  • Clinical image processing
  • Voice-to-text clinical note transcription
  • Patient management
  • Clinic management (ERP)
  • Internal accounting and inventory
  • Human resources (employees, absences, tasks)
  • Business metrics and statistics
  • Informational scientific library

Skymedic AI is NOT a medical device and does not replace professional healthcare judgment.

3. ACCEPTANCE OF TERMS

Access, registration, and use of the Platform implies full and unconditional acceptance of these Terms of Use.

4. AUTHORIZED USERS

The Platform is intended exclusively for healthcare professionals, clinics, and legally authorized medical centers.

The user declares:

  • Being legally authorized to practice their profession
  • Complying with applicable healthcare regulations
  • Being responsible for the clinical use of the Platform

The primary user may create accounts for employees or collaborators, being responsible for their use.

5. REGISTRATION AND USER ACCOUNT

To use Skymedic AI, it is necessary to create an account by providing data such as:

  • Username
  • Email address
  • Professional data

The user guarantees the accuracy and currency of the information provided.

6. PATIENT DATA AND GDPR ROLES

6.1 Types of data

The user may enter patient data such as:

  • Internal identifiers or name
  • Sex and/or gender
  • Date of birth
  • Phone number
  • Clinical photographs
  • Clinical notes (text and voice)
  • Informed consents
  • Treatment information

6.2 GDPR Responsibility

  • The professional user acts as the Data Controller
  • Skymedic AI acts as the Data Processor

The user guarantees having obtained the patient's informed consent.

7. USE OF ARTIFICIAL INTELLIGENCE AND THIRD-PARTY AI SERVICES

The Platform uses third-party artificial intelligence services for:

  • Facial and dermatological analysis through AI services from Google LLC
  • Indicative clinical evaluation of facial images through AI services from Google LLC
  • Processing and evaluation of clinical images
  • Voice-to-text transcription
  • Generation of indicative treatment proposals

7.1 Data shared with AI services

When using facial analysis features, the following data may be sent to the indicated third-party AI services:

  • Facial images captured during the 3D scan
  • Patient age (if provided)
  • User's preferred language

These services process data exclusively to generate the requested analysis, under GDPR-compliant agreements. Images sent are not permanently stored on third-party servers.

The user will be informed and must give express consent before their data is sent to third-party AI services.

⚠️ AI-generated results:

  • Are indicative only
  • Do not constitute a medical diagnosis
  • Do not replace professional judgment
  • Are not binding

8. THIRD-PARTY SERVICES

To provide the service, Skymedic AI uses the following external providers:

  • Google LLC — facial image analysis using artificial intelligence
  • Convex, Inc. — cloud data storage and processing

All providers process data solely for service provision, under GDPR-compliant agreements.

9. CLINIC MODE – ERP

The accounting, inventory, human resources, and metrics modules are support tools and do not replace professional accounting, tax, or legal advice.

10. SCIENTIFIC LIBRARY

The Platform may display links or search results from public sources (e.g., PubMed). Skymedic AI does not guarantee the accuracy or currency of third-party content and assumes no responsibility for it.

11. INTELLECTUAL PROPERTY

All rights to the Platform, software, algorithms, designs, and trademarks belong to Skymedic AI or its licensors.

12. PROHIBITED USES

The following are prohibited:

  • Using the Platform without patient consent
  • Uploading false or unlawful data
  • Copying, decompiling, or exploiting the software
  • Sharing credentials without authorization

13. LIMITATION OF LIABILITY

Skymedic AI shall not be liable for:

  • Clinical decisions made by the user
  • Damages arising from clinical use of the information
  • Errors due to incorrect data entered by the user
  • Legal non-compliance by the healthcare professional

14. SERVICE SUSPENSION

Skymedic AI may suspend or cancel accounts for breach of these Terms.

15. APPLICABLE LAW

These Terms are governed by European Union law and applicable Spanish legislation.

All content, trademarks, and software are the property of Skymedic AI or third-party licensors.

5. APPLICABLE LAW

This Legal Notice is governed by Spanish and European legislation.
